I have income or assets in both Canada and the U.S. — can you help?

Absolutely. Cross-border taxation is one of our core specialties. We work with U.S. citizens residing in Canada, Canadian citizens working or investing in the U.S., and corporations operating across both countries. What happens to my RRSP, TFSA, or RESP if I move to the United States?

Canadian registered accounts are treated differently under U.S. tax law. RRSPs retain their tax-deferred status under the Canada-U.S. tax treaty but must be reported on your FBAR and Form 8938. TFSAs and RESPs, however, are not recognized as tax-sheltered accounts by the IRS, meaning any income earned in them becomes taxable in the U.S. non-compliance with foreign reporting requirements can trigger significant penalties. Our cross-border tax team can help you file accurately and determine whether consolidating or restructuring certain assets may be beneficial.

What is the Voluntary Disclosure Program (VDP)?

The VDP is a program offered by the Canada Revenue Agency that gives eligible taxpayers a second chance to correct errors or omissions on past tax returns — such as unreported income, ineligible expense claims, or undisclosed foreign-source income. If your disclosure is accepted, the CRA will not pursue criminal prosecution and may waive certain penalties, though taxes and interest are still payable. The application process is detailed and must meet strict criteria, including that it could be more beneficial if self-initiated before the CRA contacts you. Our team has extensive experience guiding clients through every step of the VDP process.
